2nd conviction within 10 years:
up to $1,000.00 Fine; 90 Days to 1 Year in Jail; DUI School 30 Days of Community Service; Mandatory Alcohol Evaluation and/or Treatment; Up to 1 Year Probation; 3 Year Loss of License; Ignition Interlock Device
Participation in DUI Court; Victim Impact Panel
3rd conviction within 10 years:
high and aggravated misdemeanor; fine up To $5,000.00; 120 Days to a Year in Jail; 30 Days Community Service; Alcohol Evaluation and/or Treatment; Up to 1 Year Probation; 5 Year License Revocation; Ignition Interlock, Device Declaration as Habitual Violator; Participation in DUI Court; Victim Impact Panel
4th conviction within 10 years:
fine of $5,000.00; One to Five Years in State Prison.
Note: The Georgia legislature passed new legislation this effective July 1, 2011 which will make the “look back” period 10 years and to make a 4th in 10 years conviction a felony. The felony look back period applies only to DUIs committed after July 1, 2011.
